1. Introduction

These Terms and Conditions (“Terms”) govern your use of the Jabo AI personal assistant service (“Service”) operated by EnCoCoEU S.L., located at Plaza del Actor Enrique Rambal 17, 46022 - Valencia, Spain (“we,” “our,” or “us”).

By using the Service, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use the Service.

2. Service Description

Jabo is an AI-powered personal assistant accessible through messaging platforms including Telegram and WhatsApp. The Service provides capabilities including but not limited to:

  • Natural language conversation and task assistance
  • Code execution in isolated environments (JavaScript, Python, Bash)
  • Web browsing and automation
  • Google Workspace integration (Gmail, Calendar, Drive, Contacts)
  • Persistent memory and personalized assistance
  • Skills marketplace and custom automations
  • Scheduled tasks and reminders

3. Acceptable Use Policy

You agree to use the Service only for lawful purposes. You must not:

  • Use the Service to engage in any illegal activity or promote illegal activities
  • Attempt to gain unauthorized access to other users' data or accounts
  • Use the Service to harass, abuse, or threaten others
  • Upload malicious code, viruses, or any software intended to damage or alter computer systems
  • Use the Service to generate spam, phishing content, or deceptive communications
  • Attempt to reverse engineer, decompile, or extract the source code of the Service
  • Use the code execution feature to mine cryptocurrency, launch denial-of-service attacks, or perform unauthorized network scanning
  • Use the Service to process, store, or transmit data that violates any applicable data protection laws
  • Circumvent or attempt to circumvent any security measures, rate limits, or usage restrictions

We reserve the right to suspend or terminate your access to the Service if we determine, in our sole discretion, that you have violated this Acceptable Use Policy.

4. AI-Generated Content Disclaimer

The Service uses artificial intelligence (currently Google Gemini models) to generate responses and perform tasks. You acknowledge and agree that:

  • AI responses may be inaccurate: AI-generated content may contain errors, omissions, or outdated information. You should verify important information independently.
  • No professional advice: AI responses do not constitute legal, medical, financial, or other professional advice. Consult qualified professionals for such matters.
  • Content responsibility: You are responsible for reviewing and validating any AI-generated content before using it for any purpose.
  • AI limitations: The AI may not always understand context correctly, especially in nuanced or ambiguous situations.

5. Code Execution Liability

The Service allows you to execute code in isolated Kubernetes environments. Regarding code execution:

  • Isolated environments: Code runs in sandboxed containers with limited resources and network access. Each execution environment is ephemeral and destroyed after use.
  • User responsibility: You are solely responsible for the code you request to be executed. We are not liable for any consequences of code execution, including data loss, unintended side effects, or incorrect results.
  • No warranties: We do not guarantee the correctness, completeness, or reliability of code execution results.
  • Resource limits: Code execution is subject to time limits, memory limits, and other resource constraints that may be modified at any time.

6. Account Linking and Data Access Consent

When you connect third-party accounts (such as Google) to the Service:

  • You explicitly consent to Jabo accessing and acting on your data within the scope of permissions you grant (e.g., reading emails, creating calendar events)
  • You can revoke access at any time by disconnecting the integration within the Service or through the third-party provider's settings
  • We store access tokens encrypted with AES-256-GCM and never share them with third parties
  • Actions performed on your behalf (sending emails, modifying calendar events) are executed at your request and are your responsibility
  • We recommend reviewing the permissions carefully before connecting any third-party account

7. Service Availability

  • The Service is provided on an “as-is” and “as-available” basis without any Service Level Agreement (SLA) guarantees
  • We may experience downtime for maintenance, updates, or unforeseen technical issues
  • We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice
  • AI model availability depends on third-party providers and may be subject to rate limits or outages beyond our control
  • We do not guarantee specific response times, uptime percentages, or feature availability

8. Intellectual Property

8.1 Your Content

  • You retain full ownership of all content you create, upload, or generate through the Service
  • You retain ownership of any custom skills you create on the platform
  • By using the Service, you grant us a limited license to process your content solely for the purpose of providing the Service

8.2 Our Content

  • The Service, including its design, features, and underlying technology, is owned by EnCoCoEU S.L. and protected by applicable intellectual property laws
  • Community skills shared via the marketplace are subject to their respective licenses as specified by their creators

9. Limitation of Liability

To the maximum extent permitted by applicable law:

  • We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service
  • Our total liability for any claims related to the Service shall not exceed the amount you have paid us in the 12 months preceding the claim (if any)
  • We are not liable for any actions taken by the AI assistant on your behalf, including but not limited to emails sent, calendar events created, or code executed

10. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data.

11. Modifications to Terms

We may update these Terms from time to time. We will notify you of significant changes by posting a notice through the Service. Your continued use of the Service after changes take effect constitutes acceptance of the modified Terms.

12. Termination

Either party may terminate the use of the Service at any time:

  • You may stop using the Service at any time and request deletion of your data
  • We may suspend or terminate your access if you violate these Terms
  • Upon termination, we will delete your personal data in accordance with our Privacy Policy and GDPR obligations

13. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Spain. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Valencia, Spain.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions shall remain in full force and effect.
